Terms of Service

1. Acceptance of These Terms

By creating an account or using Nano Banana 2.1 (the "Service", at nano-banana-21.net), you agree to these Terms of Service and to our Privacy Policy and Refund Policy. If you do not agree, do not use the Service.

2. What the Service Is

You write a prompt, optionally add up to 14 reference images (JPEG, PNG, or WebP), and choose an aspect ratio, a resolution (1K, 2K, or 4K), and how many images to generate (1 to 4). The Service then generates your images: from text alone, or by editing and combining your reference images. By default a request makes one 1K image with the aspect ratio set to Auto. Your generated images are kept in your History, where you can view and download them.

Images are generated by third-party AI providers. Reference images and generated images are stored in cloud object storage. If a generation fails, it is not charged.

We may add, change, or remove features, models, and providers at any time; where a change materially reduces the Service, we will give reasonable notice when practical.

3. Accounts

• You can sign in with a one-time link sent to your email address, or with Google. You must provide accurate information and keep access to your email and Google accounts secure. Activity under your account is your responsibility; tell us promptly about any unauthorized use.
• You must be at least 13 years old (or the higher minimum age required where you live) to use the Service.
• One person may not operate multiple accounts to claim the free sign-up credits more than once; we may block such attempts and close those accounts.

4. Photos and Likeness

By uploading a photo of a person as a reference image you confirm that:

• the photo shows you, or a person who has given you permission to use their likeness in this way;
• you will not upload photos of minors without their parent or guardian's consent;
• you will not use photos of public figures or celebrities to impersonate them;
• the resulting image will not be used to create or spread content that is sexual, hateful, harassing, or defamatory, or that is intended to deceive, for example passing an edited image off as a real photo of a real person.

You are responsible for how you share the images you create. We may refuse to generate, remove content, and suspend or terminate accounts that break these rules, without refund of used credits.

5. Credits and Payment

• The Service is paid for with credits, bought in one-time credit packs or received through subscriptions. Payments are processed by Stripe. Prices may change; the price shown at checkout applies.
• What an image costs. Each image is charged separately, and the total credit cost is shown on the Generate button before you start. An image made from text alone costs 6 credits at 1K, 8 credits at 2K, and 16 credits at 4K. Reference images add a little to the cost: with all 14 reference images, an image costs 9 credits at 1K, 11 at 2K, and 19 at 4K. 2K and 4K output and generating 2 to 4 images at once are available while you have an active subscription or unused credits from a credit pack.
• Credit packs (one-time): Basic (300 credits, $29.90), Growth (860 credits, $49.90), Pro (3,530 credits, $99.90), Studio (9,040 credits, $199.90), Max (48,090 credits, $799.90). Pack credits never expire.
• Subscriptions renew automatically until you cancel. Monthly: Basic ($14.90/month, 500 credits per month), Pro ($39.90/month, 2,400 credits per month), Studio ($99.90/month, 8,000 credits per month). Yearly, billed once a year: Basic ($118.80/year, 4,750 credits), Pro ($286.80/year, 22,940 credits), Studio ($766.80/year, 76,680 credits); the whole year's credits are granted at the start of the billing year. By subscribing, you authorize us (through Stripe) to charge your payment method at the start of each billing period until you cancel.
• Subscription credits are valid for the current billing period only: monthly credits expire at the end of that month's period, yearly credits at the end of the billing year. Unused subscription credits do not roll over.
• All your credits share one balance, and the oldest credits are used first.
• Canceling: you can cancel any time from Settings → Billing. Canceling stops the next renewal; your plan stays active, with its credits, until the end of the period you have paid for. We do not give prorated refunds for partial periods, except as described in the Refund Policy.
• Credits cannot be transferred or exchanged for cash.
• Redemption codes. You can redeem a code in Settings → Credits. A code works only before its expiry date, up to the number of uses set for it, and only for the account it is bound to, if any. The credits it adds expire on the date set for that code; if no date is set, they never expire.
• Free credits. Every new account receives 6 free credits at sign-up, enough for one 1K image made from text. These credits never expire. This offer may change or end at any time.
• Failed generations are never charged: if a generation errors, times out, or is refused by the model's safety filter, its credits return to your balance automatically. An image that is generated but that you don't like is not a failure.

6. Acceptable Use

In addition to Section 4, you agree not to use the Service to:

• create sexual content, or any content sexualizing a minor or anyone who appears to be a minor, absolutely and without exception;
• infringe copyright, trademark, publicity, or other rights of any party;
• create content that is illegal where you live or where we operate, promotes violence or self-harm, or constitutes harassment, hate, or fraud;
• probe, overload, scrape, or interfere with the Service or its providers, or circumvent safety filters or usage limits.

7. Your Content and Generated Images

• Your prompts and uploads remain yours. You grant us a limited license to host and process them solely to operate the Service: sending them to the third-party AI provider that generates your image. We do not use them to train our own models.
• Generated images are AI-generated. Subject to these Terms and to third-party rights (including the rights of people depicted), we grant you a license to use your generated images for personal and commercial purposes.
• AI models can produce similar outputs for different users; we cannot guarantee uniqueness, and you are responsible for verifying that your use does not infringe third-party rights.
• You can delete your uploaded and generated images at any time from Settings → Files, and remove creations from your History. To delete your account, email support@nano-banana-21.net.

8. Availability

The Service is provided on a best-effort basis: we do not guarantee uninterrupted availability, generation speed, or that any given model or provider remains offered.

9. Termination

You may stop using the Service and request account deletion at any time by emailing support@nano-banana-21.net; if you have an active subscription, cancel it from Settings → Billing to stop future renewals. We may suspend or terminate accounts that breach these Terms, initiate fraudulent chargebacks, or create risk for the Service, other users, or people depicted in content. Sections 4, 6, 7, 10, and 11 survive termination.

10. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. To the maximum extent permitted by law, our total liability arising out of the Service is limited to the amounts you paid us in the twelve months before the claim; we are not liable for indirect, incidental, or consequential damages. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

11. Changes to These Terms

We may update these Terms from time to time. The date above (October 7, 2026) reflects the latest revision; material changes will be announced in the product. Continued use after a change takes effect constitutes acceptance.
